MyPick is a service owned and operated by PickOS Inc., its parent company. MyPick is the service name; PickOS Inc. is the legal entity operating the service.

In this document, “we,” “us,” and “our” refer to PickOS Inc. References to MyPick’s rights, obligations, or actions mean PickOS Inc. acting through the MyPick service. References to the MyPick website, apps, marketplace, or platform describe the service. For agreements with MyPick, your contracting party is PickOS Inc.; the responsibilities of sellers and other third parties remain as described in the applicable agreement.

About These App Terms

These Mobile Application Terms ("App Terms") apply to the MyPick mobile applications made available through app stores and govern your use of the apps. They supplement the Buyer Terms & Conditions, which continue to apply to purchases you make, and our Privacy Policy and Cookie Policy apply to information handled through the apps. If these App Terms conflict with the Buyer Terms & Conditions on an app-specific matter, these App Terms control for that matter.

License to Use the App

Subject to your compliance with these terms, PickOS Inc. grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on devices you own or control, solely for your personal, non-commercial use of the Platform. The app is licensed to you, not sold, and PickOS Inc. reserves all rights not expressly granted.

App Store Terms Also Apply

These App Terms are between you and PickOS Inc., operating the MyPick service, not with Apple Inc. or Google LLC, but each app store's own terms of service also apply to your download and use of the app. Apple and Google are third-party beneficiaries of these App Terms with respect to their respective platforms and may enforce them against you. PickOS Inc. is responsible for addressing claims about the app relating to its operation, legal compliance, or stated functionality, subject to mandatory app-store terms and applicable law.

Updates and Availability

We may release updates, patches, and new versions of the app from time to time, and depending on your device settings, updates may install automatically. Certain versions may be discontinued or become unsupported, and features may change or be removed. We do not promise that any particular feature will remain available in the app.

Device and System Requirements

The app requires a compatible device and operating system version, which are listed on its app store page. Your device needs an internet connection for most features, and data charges from your mobile carrier may apply. You are responsible for keeping your device and operating system current enough to use the app securely.

In-App Permissions

With your consent, the app may request access to device features to enable specific functions: the camera to scan products or add photos to reviews, notifications to deliver order updates and offer alerts, and location to show relevant availability or shipping estimates. You can grant or withdraw these permissions at any time in your device settings, and the app remains usable for core shopping features. User Conduct in the App

When using the app, you must follow the acceptable-use rules in the Buyer Terms & Conditions. Do not interfere with the app's operation, access it through unofficial clients or modified versions, or use it in a way that could harm other users or overload our systems.

Points and Virtual Items

Loyalty Points and promotional balances shown in the app follow the Customer Rewards, Points & Referral Policy. They are promotional, have no cash value, are non-transferable, and may be adjusted, frozen, or revoked as described there.

Termination

You can stop using the app and delete it at any time; deleting the app does not close your MyPick account or cancel pending orders. We may suspend or terminate your access to the app, with or without notice, for violations of these App Terms, fraud, or other misuse, and we may discontinue the app itself. Sections that by their nature should survive — including license limits, disclaimers, and liability limits — survive termination.

Third-Party Links and Content

The app may link to third-party websites, services, or content that we do not control. We are not responsible for third-party content or practices, and your dealings with third parties accessed through the app are solely between you and them.

Disclaimers and Limitation of Liability

The disclaimers and limitations of liability in the Buyer Terms & Conditions apply to the app. To the fullest extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind, and MyPick is not liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use the app, except where such limitations are prohibited by law.
